KUNSTWERKEN
Artikel 1 – Definities
In deze Algemene Voorwaarden wordt verstaan onder:
1. ‘Het kunstwerk’: het werk dat nader is aangeduid in de overeenkomst
tussen de kunstenaar en de klant.
2. ‘De kunstenaar’: de maker van het kunstwerk. Sof-Paintings (BTW:
BE0462.412.757)
3. ‘De klant’: de natuurlijk persoon of rechtspersoon die met
Sof-Paintings een overeenkomst aangaat.
Artikel 2 – Toepasselijkheid Algemene Voorwaarden
Deze Algemene Voorwaarden zijn van toepassing op alle overeenkomsten,
opdrachten, aanbiedingen en offertes, gesloten met of uitgebracht door
Sof-Paintings.
Artikel 3 – Totstandkoming van de overeenkomst
De overeenkomst tussen Sof-Paintings en de klant komt tot stand door
aanvaarding van het aanbod van Sof-Paintings door de klant.
Artikel 4 – Prijzen
Prijswijzigingen die uit de wet voortvloeien zoals die ter zake van
BTW kunnen aan de klant worden doorberekend.

Artikel 2 – Toepasselijkheid Algemene Voorwaarden
Deze Algemene Voorwaarden zijn van toepassing op alle overeenkomsten,
opdrachten, aanbiedingen en offertes, gesloten met of uitgebracht door
Sof-Paintings.
Artikel 3 – Totstandkoming van de overeenkomst
De overeenkomst tussen Sof-Paintings en de klant komt tot stand door
aanvaarding van het aanbod van Sof-Paintings door de klant.
Artikel 4 – Prijzen
Prijswijzigingen die uit de wet voortvloeien zoals die ter zake van
BTW kunnen aan de klant worden doorberekend.
Eveneens de transport- en verzekeringskosten worden doorberekend aan de klant.
Artikel 5 – Koop van een Kunstwerk
1. Indien de overeenkomst de koop van een kunstwerk betreft worden in
de op te maken overeenkomst de gegevens van het kunstwerk, de gegevens
van de klant, de wijze van betalen, de wijze van aflevering en overige
bijzonderheden vastgelegd.
2. Een opgegeven termijn voor aflevering is steeds indicatief, tenzij
uitdrukkelijk anders is overeengekomen.
4. Aflevering van het kunstwerk geschiedt op de wijze zoals
overeengekomen in de overeenkomst.
5. Klachten over gebreken aan het gekochte kunstwerk dienen tijdig na
constatering daarvan bij Sof-Paintings te worden ingediend,
waarbij binnen één maand in ieder geval tijdig is. Niet tijdig klagen
leidt tot verlies van rechten.
Artikel 6 – Betaling
1. Betaling door de klant geschiedt:
– contant, per overschrijving

1. "The work of art": the work specified in the agreement
between the artist and the client.
2. "The artist": the creator of the artwork. Sof-Paintings (VAT:BE0462.412.757)
3. "The customer": the natural or legal person who is with
Sof-Paintings enters into an agreement.
Article 2 - Applicability of the General Terms and Conditions
These Terms and Conditions apply to all agreements,
orders, offers and quotations, concluded with or issued by Sof Paintings.
Article 3 - Formation of the agreement
The agreement between Sof-Paintings and the customer is established
acceptance of the Sof-Paintings offer by the customer.
Article 4 - Prices
Price changes resulting from the law such as those with regard to
VAT can be passed on to the Customer.
Also shipping-, insurance- and other transport costs will be charged to the customer.
Article 5 - Purchase of an Artwork
1. If the agreement concerns the purchase of a work of art
the agreement to be drawn up the data of the work of art, the data
of the customer, the method of payment, the method of delivery and others
details.
2. A specified delivery time is always indicative, unless
expressly agreed otherwise.
4. Delivery of the artwork takes place in the manner as
agreed in the agreement.
5. Complaints about defects in the purchased work of art must be timely received
finding thereof to be submitted to Sof-Paintings,
in which case it is in any case timely within one month. Don't complain in time
leads to loss of rights.
Article 6 - Payment
1. Payment by the customer is made:
- cash, or by bank transfer; credit card payments;
- based on an invoice.
2. If an invoice is sent (by post or by e-mail), the payment term is 15
working days from the invoice date. By the mere expiry
of this period the customer is in default and the customer is from the date
statutory interest on the occurrence of the default.
3. The extrajudicial reasonably made by Sof-Paintings
costs are borne by the customer.
Article 7 - Retention of title and right of retention
1. As long as the customer does not receive the full amount of the purchase price with
Sof-Paintings reserves the right to pay any additional costs
the ownership of the artwork. In that case the ownership will be lost
the customer as soon as the customer fulfills all his obligations towards him
Sof-Paintings has met.
Article 8 - Personal Assignment
1. Provided that the color is personal, the customer is obliged to view the painting
made by order of Sof-Paintings.
2. Sof-Paintings will inform the customer by means of photos
bringing the claim of the personal assignment and desired
make adjustments as required.
Article 9 - Personal Data Protection Act
1. Sof-Paintings will process the personal data of the customer and
record in a file. The purpose of processing the personal data is the ability of Sof-Paintings
to comply with the agreement it has entered into with the customer and also to the customer
to keep abreast of Sof-Paintings and the activities that it unfolds.
2. The customer can contact Sof-Paintings at any time with the
request him / her to state whether and if so which one concerns him / her
personal data are processed. If the customer believes that the
personal data improved, supplemented, deleted or protected
the customer must do this in writing by mail or by
letter to Sof-Paintings.
Article 10 - Intellectual Property
1. The copyright on the artwork remains with the
artist. From this right of the artist flow for the customer
restrictions on the use, disclosure, and disclaimer
reproduction of the work of art.
Article 11 - Force majeure
1. In the event of force majeure, Sof-Paintings has the right to implement it
suspend the contract or the contract in whole or
to partially dissolve, without the customer being any
right or compensation of damage, costs or interest.
The artist will immediately inform the customer of each case
force majeure and try to satisfy both parties
alternative.
2. Force majeure: strikes, death, fire, transport, blockage,
molestation and in general all unforeseen circumstances
whose compliance with the agreement no longer applies to the contractor
can be required.
3. Sof-Paintings will perform every service to the best of its ability
entitled to engage third parties in and for the performance of a service
switch.
Article 12 - Applicable law and disputes
On the agreement and any other legal relationships between the
client and Sof-Paintings, Belgian law applies.

1. Indien de overeenkomst de koop van een kunstwerk betreft worden in
de op te maken overeenkomst de gegevens van het kunstwerk, de gegevens
van de klant, de wijze van betalen, de wijze van aflevering en overige
bijzonderheden vastgelegd.

Door het enkele verstrijken van deze termijn is de klant in verzuim en is de klant
vanaf de datum van het intreden van het verzuim wettelijke rente verschuldigd.
3. De door Sof-Paintings in redelijkheid gemaakte buitengerechtelijke
kosten komen voor rekening van de klant.
Artikel 7 – Eigendomsvoorbehoud en recht van terughouding
1. Zolang de klant niet het volledige bedrag van de koopsom met
eventueel bijkomende kosten heeft voldaan, behoudt Sof-Paintings zich
de eigendom van het kunstwerk voor. In dat geval gaat de eigendom op
de klant over, zodra de klant aan al zijn verplichtingen jegens
Sof-Paintings heeft voldaan.
Artikel 8 – Persoonlijke Opdracht
1. Mits persoonlijk getint is de klant verplicht het schilderij
gemaakt door Sof-Paintings in opdracht af te nemen.
2. Sof-Paintings zal de klant door middel van foto’s op de hoogte
brengen van de vordering van de persoonlijke opdracht en gewenste
aanpassingen, naar kunnen, uitvoeren.
Artikel 9 – Wet Bescherming Persoonsgegevens
1. Sof-Paintings zal de persoonsgegevens van de klant verwerken en
opnemen in een bestand. Het doel van de verwerking van de
persoonsgegevens is het door Sof-Paintings kunnen nakomen van de
overeenkomst die zij met de klant is aangegaan alsmede om de klant op
de hoogte te houden van Sof-Paintings en de activiteiten die het
ontplooit.
2. De klant kan zich te allen tijde tot Sof-Paintings wenden met het
verzoek hem/haar mede te delen of en zo ja, welke hem/haar betreffende
persoonsgegevens worden verwerkt. Indien de klant van mening is dat de
persoonsgegevens verbeterd, aangevuld, verwijderd of afgeschermd
dienen te worden, dient de klant dit schriftelijk per mail of per
brief aan Sof-Paintings te melden.
Artikel 10 – Intellectuele eigendom
1. Het auteursrecht op het kunstwerk blijft berusten bij de
kunstenaar. Uit dit recht van de kunstenaar vloeien voor de klant
beperkingen voort betreffende het gebruik, de openbaarmaking en de
verveelvoudiging van het kunstwerk.
Artikel 11 – Overmacht
1. In geval van overmacht heeft Sof-Paintings het recht de uitvoering
van de opdracht op te schorten of de overeenkomst geheel of
gedeeltelijk te ontbinden, zonder dat de klant uit dien hoofde enig
recht of vergoeding van schade, kosten of interesten kan doen gelden.
De kunstenaar zal de klant direct op de hoogte stellen van elk geval
van overmacht en trachten een voor beide partijen bevredigend
alternatief aan te bieden.
2. Overmacht: werkstakingen, overlijden, brand, vervoer, stremming,
molest en in het algemeen alle onvoorziene omstandigheden ten gevolge
waarvan naleving van de overeenkomst niet meer van de opdrachtnemer
kan worden gevergd.
3. Sof-Paintings zal elke dienst naar beste kunnen uitvoeren en is
gerechtigd bij en voor de uitvoering van een dienst derden in te
schakelen.
Artikel 12 – Toepasselijk recht en geschillen
Op de overeenkomst en eventuele andere rechtsbetrekkingen tussen de
klant en Sof-Paintings is Belgisch recht van toepassing.
3. De door Sof-Paintings in redelijkheid gemaakte buitengerechtelijke
kosten komen voor rekening van de klant.
Artikel 7 – Eigendomsvoorbehoud en recht van terughouding
1. Zolang de klant niet het volledige bedrag van de koopsom met
eventueel bijkomende kosten heeft voldaan, behoudt Sof-Paintings zich
de eigendom van het kunstwerk voor. In dat geval gaat de eigendom op
de klant over, zodra de klant aan al zijn verplichtingen jegens
Sof-Paintings heeft voldaan.
Artikel 8 – Persoonlijke Opdracht
1. Mits persoonlijk getint is de klant verplicht het schilderij
gemaakt door Sof-Paintings in opdracht af te nemen.
2. Sof-Paintings zal de klant door middel van foto’s op de hoogte
brengen van de vordering van de persoonlijke opdracht en gewenste
aanpassingen, naar kunnen, uitvoeren.
Artikel 9 – Wet Bescherming Persoonsgegevens
1. Sof-Paintings zal de persoonsgegevens van de klant verwerken en
opnemen in een bestand. Het doel van de verwerking van de
persoonsgegevens is het door Sof-Paintings kunnen nakomen van de
overeenkomst die zij met de klant is aangegaan alsmede om de klant op
de hoogte te houden van Sof-Paintings en de activiteiten die het
ontplooit.
2. De klant kan zich te allen tijde tot Sof-Paintings wenden met het
verzoek hem/haar mede te delen of en zo ja, welke hem/haar betreffende
persoonsgegevens worden verwerkt. Indien de klant van mening is dat de
persoonsgegevens verbeterd, aangevuld, verwijderd of afgeschermd
dienen te worden, dient de klant dit schriftelijk per mail of per
brief aan Sof-Paintings te melden.
Artikel 10 – Intellectuele eigendom
1. Het auteursrecht op het kunstwerk blijft berusten bij de
kunstenaar. Uit dit recht van de kunstenaar vloeien voor de klant
beperkingen voort betreffende het gebruik, de openbaarmaking en de

1. In geval van overmacht heeft Sof-Paintings het recht de uitvoering
